  3.         TITLE II--STORED WIRE AND ELECTRONIC COMMUNICA-
  4.             TIONS AND TRANSACTIONAL RECORDS ACCESS
  5.      
  6. Sec. 201. TITLE 18 AMENDMENT.
  7.      
  8.    Title 18, United States Code, is amended by inserting after
  9. chapter 119 the following:
  10.      
  11. "CHAPTER 121--STORED WIRE AND ELECTRONIC COMMUNICATIONS AND
  12.               TRANSACTIONAL RECORDS ACCESS
  13.

  16. SS 2701. Unlawful access to stored communications
  17.      
  18.      "(a)  Offense.--Except as provided in subsection (c) of this
  19. section whoever--
  20.           "(1) intentionally accesses without authorization a
  21.      facility through which an electronic communication service
  22.      is provided; or
  23.           "(2) intentionally exceeds an authorization to access
  24.      that facility;
  25. and thereby obtains, alters, or prevents authorized access to a
  26. wire or electronic communication while it is in electronic
  27. storage in such system shall be punished as provided in
  28. subsection (b) of this section.
  29.      "(b)  Punishment.--The punishment for an offense under
  30. subsection (a) of this section is--
  31.           "(1) if the offense is committed for purposes of
  32.      commercial advantage, malicious destruction or damage, or
  33.      private commercial gain--
  34.                "(A) a fine of not more than $250,ooo or
  35.           imprisonment for not more than one year, or both, in
  36.           the case of a first offense under this subparagraph;
  37.           and
  38.                "(B) a fine under this title or imprisonment for
  39.           not more than two years, or both, for any subsequent
  40.           offense under this subparagraph; and
  41.           "(2) a fine of not more than $5,000 or imprisonment
  42.      for not more than six months, or both, in any other case.
  43.      "(c) Exceptions.--Subsection (a) of this section does not
  44. apply with respect to conduct authorized--
  45.           "(1) by the person or entity providing a wire or
  46.      electronic communications service;
  47.           "(2) by a user of that service with respect to a
  48.      communication of or intended for that user; or
  49.           "(3) in section 2703,2704 of 2518 of this title.

  51. ss. 2702. Disclosure of contents
  52.      
  53.      "(a) Prohibitions.--Except as provided in subsection (b)--
  54.           "(1) a person or entity providing an electronic
  55.      communication service to the public shall not knowingly
  56.      divulge to any person or entity the contents of a
  57.      communication while in electronic storage by that service;
  58.      and
  59.           "(2) a person or entity providing remote computing
  60.      service to the public shall not knowingly divulge to any
  61.      person or entity the contents of any communication which
  62.      is carried or maintained on that service--
  63.                "(A) on behalf of, and received by means of
  64.           electronic transmission from (or created by means of
  65.           computer processing of communications received by
  66.           means of electronic transmission from), a subscriber
  67.           or customer of such service; and
  68.           "(B) solely for the purposed of providing storage or
  69.           computer processing services to such subscriber or
  70.           customer, if the provider is not authorized to access
  71.           the contents of any such communications for purposes
  72.           of providing any services other than storage or
  73.           computer processing.
  74.      "(b) Exceptions.-- A person or entity may divulge the
  75. contents of a communication--
  76.           "(1) to an addressee or intended recipient of such
  77.      communication or an agent of such addressee or intended
  78.      recipient;
  79.           "(2) as otherwise authorized in section 2516,
  80.      2511(2)(1) , or 2703 of this title;
  81.           "(3) with the lawful consent of the originator or an
  82.      addressee or intended recipient of such communication, or
  83.      the subscriber in the case of remote computing service;
  84.           "(4) to a person employed or authorized or whose
  85.      facilities are used to forward such communication to its
  86.      destination;
  87.           "(5) as may be necessarily incident to the rendition
  88.      of the service or to the protection of the rights or
  89.      property of the provider of that service; or
  90.           "(6) to a law enforcement agency, if such contents--
  91.                "(A) were inadvertently obtained by the service
  92.           provider; and
  93.                "(B) appear to pertain to the commission of a
  94.           crime.
